The course Fundamentals of Labor and Safety Legislation addresses legal protection and corporate responsibility in promoting safe work environments. The regulatory basis is the Consolidation of Labor Laws (CLT), which imposes labor, civil, and criminal obligations on employers, holding them responsible for compliance with preventive measures and for workers’ physical and mental integrity. Failure to comply with the law may result in administrative penalties, compensation for material and moral damages, and criminal liability in cases of serious negligence. The legal hierarchy must be respected, prioritizing the Federal Constitution, followed by the CLT, ILO conventions, social security legislation, decrees, and ordinances, including the Regulatory Standards (NRs), which detail essential technical procedures in the daily practice of occupational safety.
The course emphasizes workers’ rights, such as the right to refuse to work under conditions of serious and imminent risk, as well as extreme measures applicable by labor inspection authorities, such as embargoes and interdictions, which ensure the interruption of dangerous activities. The strict application of the NRs requires detailed documentation, including technical reports, PPE delivery records, and Occupational Health Certificates (ASOs), ensuring legal compliance and avoiding negative social security impacts, such as an increase in the Accident Prevention Factor (FAP). Document management is therefore a critical element for protecting lives and reducing operating costs.
To illustrate the regulatory system, the course uses the analogy of construction: the CLT functions as the foundation and blueprint of a house, ensuring the legal basis, while the NRs are the technical manuals that instruct how to perform each task safely. The Occupational Safety Technician acts as the construction inspector, connecting legislation to practice, monitoring, supervising, and guiding the correct execution of procedures to prevent accidents and protect workers, consolidating safety as a strategic and legally grounded investment.
